killed his magazine model girlfriend. and the bullet evidence that could hurt his case. and that is where we start on this wednesday night. i'm bill hemmer in for shepard smith. some dramatic moments today during the bail hearing for olympic athlete oscar pistorius. witnesses say the man known as the blade runner for his carbon fiber prosthetic legs cried uncontrollably as a detective talked about the night of reeva's death. he admits killing her on valentine's day at his home. he claims it was an accident. he says he thought she was an intruder hiding in his bathroom. he said he did not put on his prosthetic legs before shooting throughout bathroom door. but today one detective testified about the trajectory of the bullets that slammed into her. he said pistorius fired the gun from a certain height and apparently aiming at somebody on the toilet. the prosecutor also showed a

floor plan of the area and argued that pistorius would have had to walk past his bed to reach the bathroom. and he should have realized reeva was not in the bed. the detective said three bullets hit her, two broke her elbow and her hip. another struck her in the head. he also said a witness heard two people having a fight that night before the shooting. that lines up with the prosecution's accusation that pistorius shot her in a fit of rage. but the athlete's relatives say that is simply not like him. >> he's not a violent person. he's a peace maker. he's always been a peace maker and that's his nature. he looks tough and he looks like the superstar and holds himself in public domain, but he's actually a very, very kind, soft person. >> a kind and soft person who admits he killed his girlfriend. still his relatives say that

they're satisfied with the hearing so far today and they say the detective's testimony was actual will he consistent with pistorius' claim that her death was nothing more than a tragic accident. greg palkot live with the news tonight. what else did we hear there today? >> hey, bill. those relatives were probably satisfied with the detective's testimony after the pistorius defense team got finished with it. they poked holes in the government's murder case against pistorius. for example, one of those witnesses to the crime turned out to be as much as 600 yards away. when pressed in on more analysis like the alleged point-blank shooting, they deferred to forensic e s. there was one apparent error, the pill found in his bedroom turned out to be, according to the defense, legal herbal medicine, bill. >> even the judge we heard from

today, even the judge got into the act. what happened there? >> that's right. yeah, the presiding judge did get involved. he questioned the detective hard about whether the well-known pistorius would be a flight risk if he was granted bail. the judge appeared not to think so. remember, that is what this hearing is all about. whether bail should be denied pistorius and whether the tough charge of premeditated murder should stick. last night most legal experts you would speak to would answer yes to both of those points. tonight many are not sure. there will be closing arguments on thursday. probably a decision by the end of the week. but that full blown trial won't be happening until later this year, bill. >> we also heard from one of the victim's friends. >> that's right. yeah. she was really the missing person in this, the victim, reeva. we spoke to a friend of hers. he told me about the shock that he felt when he heard the news. he said that she was much, much

more than just a model. here is a little bit more of what he had to say to me. >> what a loss. >> you could speak to her now, what would you say? >> what a good friend she was and how many people loved her. >> this young man told me that he would not be swayed by all the legal maneuverings. he's made up his mind about what happened and what should be done and he and a lot of people will be watching that courtroom come thursday again. back to you. >> more court tomorrow. thanks. greg palkot. here at home, search cruise found one body at the scene of a deadly explosion in kansas city. that blast injured 15 other people and destroyed one of the city's most popular restaurants. investigators say construction crews apparently hit a natural gas line, triggering that explosion. people say they felt it almost a mile away and look at the

surveillance video. you see the explosion at the restaurant on the right. and windows shattering at a travel agency on the left. the owner of that travel agency telling fox news he was at the restaurant last night, but he got out just before the blast because somebody there smelled the gas and called the fire department. >> i was in my car on the way home, just two or three minutes away, the alarm company said you got multiple alarms going off. i immediately went back within two minutes. the fire ball was reaching to the height of the building behind me. maybe seven or eight stories. >> one of the owners says he found out about the explosion when he saw it on television. mike tobin live at the soon tonight in kansas city. what is the latest on from there tonight. >> sadly, bill, the latest is that the parents of a waitress at j.j.'s have confirmed that the body removed from the charred remains of this building was indeed their daughter. her name was meghan kramer. she was missing since 6:00 o'clock last night when an

explosion, an inferno ripped through that building. everyone for about a mile around had the common story of stunned silence that followed the shock wave that ripped through this neighborhood. before and after pictures show you the power of the blast. j.j.'s restaurant, an institution in kansas city for 27 years, known for its fine selection of wine, obliterated in an instant. all of the witnesses who got close to this area said they were overpowered by the smell of natural gas before the explosion, bill. >> mike, what are you hearing from investigators? where do they say it stands at this point tonight? >> no one is challenging the notion that the utility crew hit that gas line that ultimately led to the blast. however, the question is really who is at fault. the state public service commission sent investigators out here. they have determine thus far with preliminary finding that the gas lines were all properly marked. however, they are not pointing the finger of blame at that utility crew, at least not yet.

a conclusion from their investigation could take six months, bill. >> mike tobin. thanks, in kansas city with that report tonight. a convicted double murderer was only moments from death when a court blocked a lethal injection. georgia's attorney general asking the supreme court to allow that execution to go forward. warren hill killed his girlfriend in the '80s, a few years later he beat a fellow prisoner to death with a board studded with nails. those lawyers say he's mentally disabled. it would be against the constitution, they argue, to put him to death. three action period of times who testified that he was competent enough for execution now say they were wrong. prosecutors argued the new statements from those experts are not credible. so far no response from the supreme court on that case. there are millions of americans in the path of a big winter storm. some spots could see a foot of snow and now we're hearing the storm might even bring tornadoes in february. plus north korea's newest

>> bill: fox weather alert. deadly winter storm to talk about hitting our nation's heartland. check out these images. that's the radar. more than a dozen states under watches or warnings and forecasters saying that a foot of snow could fall in some parts and that tornadoes could form in others. this is mid february now. in oklahoma, cops say a young man died when his pick up truck spun into oncoming traffic and he was hit by a truck. meanwhile, a bizarre scene here in arizona. snow forcing pga officials to suspend play. some of the golfers say they've never seen that happen before. a few of them took advantage and started a snowball fight in the parking lot. that's rickey fowler in the orange there. earlier the storm causing huge problems for motorists in

california. officials responding to multiple collisions and reports of stranded drivers in that state. no major injuries, but that same system now set to impact some 30 million americans all the way from texas to the central plains. chief meteorologist rick reichmuth is monitoring all that live tonight. where are we expecting the heaviest snow, rick? >> the heaviest is right across the plains. it's hard to believe the pictures of the snow in tucson. but this is the storm, pretty big. beginnings of the storm have moved across the plains. five to six inches across parts of kansas. the main action is back here across parts of arizona. i think we might have live shots from scottsdale, arizona. this is live shots, courtesy of ksaz. golf course towards scottsdale. and they've got snow on that. i can tell you i'm from arizona, born and raised. never seen snow sticking on the ground in scottsdale, which is

north of phoenix. very incredible shot to see this. this storm is going to eject out in towards parts of the plains tonight. by the time tomorrow morning comes, it will be here right around parts of colorado, but very heavy snow falling all day tomorrow across kansas and nebraska and parts of missouri and in toward iowa. i got to tell you, we desperately need moisture here. this is a drought monitor. you see the dark colors. this is the worst drought we have and it's across nebraska, parts of north dakota and kansas. look where the bulk of the snow will fall, it's that western kansas, western parts of nebraska and this is nothing but beneficial. it's all farmland out there. they desperately need it. in the short-term, certainly problematic with getting around on the roads. but not a ton of people out here. any moisture we can get here is really great news. >> bill: almost like mother nature drew in a one up, help that snow melts. they get all the rain water and the moisture from that. we're also talking about severe weather down south, aren't we? >> yeah. the exact same storm, the flip

side of it is the south side of it, the warmer side we'll see a chance of severe weather, west texas, maybe across the red river. not a huge tornado threat tonight. it is mostly hail and wind. tomorrow a better tornado threat right across southern parts of louisiana tomorrow and tomorrow amp. >> bill: that is bizarre. the 21st of february tomorrow. thank you. now more from kansas city, where they're getting ready for this storm. how goes it claudia? >> good evening, bill. i can tell you many folks are headed out to the hardware store tonight to get snow shovels and bags of ice melt because freezing slush and ice are expected to be the biggest problems coming as a result of this storm, especially on the roadways. as you mentioned, dangerous conditions have already turned deadly in oklahoma where it was hard to see and certainly hard to drive. snowplows and salt spreaders already hard at work on highways from california into the midwest and plains states. and in airports from tucson to kansas city, many of the airlines started canceling

flights later tonight and early tomorrow morning. so if you're flying out, be sure to call ahead. tomorrow could very well be a snow day for school children. it will be a day off for state lawmakers in kansas who have already announced no legislative business tomorrow on a count of this massive winter storm and in the meantime, as rick mentioned, farmers are praying for more. happy to have any precipitation in the midst of this long and severe drought. bill? >> bill: it's on its way. we'll talk to you tomorrow in kansas city for us tonight. new jersey's largest utility company now looking to spend billions of dollars to protect its customers against future storms like the one that devastated much of the northeast back in october. during super storm sandy, the company reported 2 million customers lost power. among the proposed fixes company officials say they want to strengthen power lines and make the electrical grid easier to fix. the state's board of utilities must approve the $3.9 billion

espionage against the u.s. but in their report today, bill, six of the seven cases they highlighted involved china. >> bill: do experts say that these moves are strong enough to stop them? n they say it's going to be hard because hackers are always coming up with new technologies to get past the latest security software. but eventually it could all just escalate into a stand-off. >> structurally, it's going to end up a lot like the concept of nuclear deterrence where countries will be deterred from engaging other countries. i would say they'll definitely be a public face and private facing side to it. >> officials say that companies and people also need to do more training and to use their heads better, maybe think twice about clicking on that single link to some web site that you never heard of that shows up in an e-mail from me to you, bill, with no message on it. delete that one.

to speak with the u.s. anti-doping agency if he wanted to soften his lifetime b. he lost his tour defrance titles and the agency banned him from cycling after it reloosed a report that accused him of extensive doping. he admitted doping in an interview with oprah winfrey. but now his lawyer says armstrong is not willing to testify under oath. the fox report's chief correspondent jonathan hunt with me now. good evening to you. what are we hearing from both sides on this? >> lance armstrong, didn't want to the media. his attorney did release a statement saying that armstrong would take part in what he called an international tribunal, but, quote, lance will not participate in u.s. ada's efforts to selectively conduct american prosecutions that only demonize selected individuals while failing to address the 95% of the sport over which usada has no jurisdiction, referring to the fact that cycling is

largely a european sport. the ceo of usada released his own statement which said in part, quote, over the last few weeks, he, lance armstrong, has led us to believe that he wanted to come in and assist usada but worried of potential criminal and civil liabilities if he did so. today learned he's choosing not to come in and be truthful and that he will not take the opportunity to work toward righting his wrongs. clearly they believe they have not heard the truth, the whole truth and nothing but the truth from him and they have no intention of allowing him to compete in any sport unless and until he does so. >> bill: if nothing changes on either side, are there legal implications? >> aside from the ban which is the negative, from competing in any sport for armstrong, there is, according to judge napolitano a positive for him in this in that he simply protects himself. listen. >> well, if he talks under oath

and he lies, or there is the per suspicion that he lied, he could be prosecuted by the justice department for lying under oath even in a noncriminal proceeding. also if he says something under oath that's inconsistent with anything else he said under oath, he could be exposed to prosecution if they materially conflict with each other. >> and the judge points out that there are a growing number of civil suits against armstrong, so at some point he will have to testify. he can't dodge this forever. >> bill: but not today. >> not today. >> bill: thank you. good to see you. so the woman accused of stabbing her ex-boyfriend, shooting him and slitting his throat from ear to ear finally testified about killing him today. she took the stand for an eighth day. she's already admitted killing her ex, claiming it was done in self-defense. today she said she was taking photos of him in the shower that day, including this picture. and when she dropped the camera,

that's when he got violent. >> he stood up and he stepped out of the shower and he picked me up. i was crouching. but he lifted me up as he was screaming stupid idiot. he body slammed me again on the tile. >> bill: she said he chased her, so she ran into a closet where she says she knew that he kept a gun. >> grabbed the gun. i ran out of the closet. he was chasing me. i turned around and we were in the middle of the bathroom, pointed at him. i thought that would stop him. if someone were point ago gun at me, i would stop. but he kept running. he got like a linebacker. he got kind of low and grabbed my waist. before he did that, the gun went off. i didn't mean to shoot him or anything. i didn't even think i was holding the trigger. i was just pointing it at him. i didn't even know that i shot

him. >> bill: she testified he threatened to kill her, but that her memory is unclear after that moment. she said she does not remember stabbing him or taking that knife to his throat. journalists and fox news contributor vicky ward with us life outside the courthouse tonight in phoenix, arizona. she said in part she want to do act like herself after all this happened. what does that mean? >> she did indeed say that, bill. and she stuck to her schedule. she did three crucial things to make it look like life is normal. she got into her car. she left. travis alexander a voice mail. she went over several times to make sure she sounded natural. she spent the night in utah as scheduled with a friend, ryan burns. they kissed. they cuddled. then she left, on time so that she would make it back for work and wait for her 4:00 o'clock shift. she got there and started basically on time. >> bill: she also gave her

reasons for lying to investigators. what did she say? >> she said that travis alexander was her friend. she wanted to protect his reputation. so basically she did not want to tell his family or anyone about the sexual feverrians or the abuse because she spent the last seven days telling the court she said this was chiefly because of his mormon beliefs. >> bill: thank you. vicky ward back on the trial again for us tomorrow. thank you in phoenix tonight. the vice president joe biden causing a bit of a stir with some comments he made during an on-line town hall on a discussion of gun rights in america. >> you don't need an ar-15. it's harder to aim. it's harder to use. and in fact, you don't need 30 rounds to protect yourself. by a shotgun. buy a shotgun. >> bill: he said he has two shotguns and inn a locked cabinet at his home in delaware. during that town hall which

parents magazine hosted, he also said he advised his wife to fire a couple rounds from their balcony if there was ever any trouble at their home in delaware. today the white house said those remarks fit the administration's position that homeowners do not need assault rifles, but do have a right to own their own gun. >> this administration, this president and vice president, this administration firmly supports our second amendment rights. upheld by the constitution and that includes the right of homeowners, law abiding american citizens to have a firearm at their home to protect themselves in their home. >> bill: it should be noted again the vice president is leading the white house task force on gun violence. a former senator now admitting he had a secret love child with the daughter of another former senator. he represented new mexico for six terms. he's now 80 years old. the republican telling the albuquerque journal that decades ago, he fathered a son with a then 24-year-old daughter of a

senate colleague from nevada. their son is now 34 years old. he's an attorney. the former senator and the woman with whom he had an affair say they're going public now because they believe somebody was about to release the information. the former senator also telling that newspaper that he informed his family about the love child a few months ago and has apologized to his wife. in a statement it reads in part, quote, i deeply regret this and am very sorry for my behavior. i hope new mexicans will view that my accomplishments for my beloved state outweigh my personal transgression, end quote. secretary of state john kerry today made his first public speech since he replaced hillary clinton. we'll tell you what he said about u.s. aid to foreign countries ahead of his first trip abroad. the vice president honored more than a dozen cops and firefighters and public safety officials with the highest civilian award in the country. that is all straight ahead here tonight inside the fox report with the spark cash card

>> bill: hundreds of thousands of defense department employees could face shorter work weeks. that's if washington can't cut a budget deal to avoid those steep spending cuts known as the sequester. that kicks in the first of march and a warning from defense secretary leon panetta. he told his staff that those cuts would affect everybody except the department's top leadership and a few workers considered essential to maintain the pentagon security. he said, quote, the rigid nature of the cuts forced upon this department and their scale will result in a serious erosion of readiness across the force. house speaker john boehner for his part responding, president obama's ultimately responsible for our military readiness, so it's fair to ask what is he doing to stop his sequester that would hollow out our armed forces, end quote. john kerry also calling on congress to prevent what he calls senseless spending cuts and not just at the pentagon. today secretary kerry gave his

>> bill: the court saga involving the ex police officer who seemed to keep losing his wives set to last another day. in september a jury convicted drew peterson of murdering his third wife, kathleen savio. the former police sergeant from illinois, also a suspect in the disappearance of his fourth wife, stacy peterson. he's facing up to 60 years in jail in the murder conviction and his current attorneys are arguing his previous attorney botched the entire case. many expected a judge to issue a ruling on whether to grant another trial, but now we know that will not happen. at least until tomorrow. steve brown tonight with the news in joliet, illinois. what's the hold up there? >> bill, two days worth of kitchen sink legal maneuvers trying to get that new trial by the peterson defense team.

we have seen over the course of two days, members of the defense team going at each other in the courtroom. former lead attorney joel brosky being questioned about his choices about witnesses called and hiring a pr firm and whether or not it was distracting him from his job. this is a far cry from team raband when we frequently saw them all smiles and often shades days before the guilty verdict came down late last summer. they even tried to call the prosecutor, james glasgow, after a brief hearing on that matter, the judge said no. if you're wondering what the defendant has been been doing, we have seen him through a spotter sitting in a courtroom often hunched over, at times with his eyes closed and maybe dozing. tomorrow we expect to hear him speak. he spoke a lot when he was accused or suspected of being involved in up with of his wives' disappearances and/or deaths. tomorrow he's expected to speak

before sentencing. it will go like this, the judge will rule, he's expected to rule against the new trial. they'll go into the sentencing phase. family, then peterson speaks, then the sentence. 20 to 60 years is the range. bill. >> bill: we'll see you then. thank you. steve brown in joliet, illinois tonight. so the infamous barefoot bandit is back in trouble with johnny law. prosecutors in washington state today filing new charges against the young man who led investigators on that two-year cross-country crime spree. colton harris moore is now 21. he is serving seven years in prison for stealing boats and planes and cars and breaking into people's homes along the way. built autopsy following as well. in 2010 it all came to an end when he was arrested in the bahamas. prosecutors north of seattle declined to sign his plea agreement. they've charged him with stealing yet another plane and flying it to an island in the pacific northwest. more to come on that. come for the weed, stay for the mountains.
